Justice is depicted with a blindfold on the eyes, a swing in one hand and a sword in the other. This representation has its origin in both Greek mythology and Christianity. The blindfold on the eyes represents impartiality. Justice, blindfolded, does not see the accused. Poor or rich, weak or powerful, common or noble, secular or religious, so she can decide in all objectivity. The symbol of the balance is one of the oldest in justice. Egyptian religion, then the Christian tradition, makes the balance the instrument of the weighing of souls and deeds. The balance represents equity, balance, prudence and harmony. These concepts form the basis of life in society, which the judiciary is responsible for preserving. As for the sword, it symbolizes the repressive aspect of justice. In the example that interests us today, that is to say the Kabyles accused of having lynched, on 11 August, a “visitor” during the terrible and devastating fires of the summer of 2021 (several dozens of victims and thousands of hectares devastated), the judges charged with making the law had not carried the usual blindfold of the justice system, but had been warned by the law. They were blinded by the judiciary. Before putting on their court suit – a symbol of uniformity, equality between the judges who make up the court and to remind them of the duties of their offices – they had, all shame drunk and with no shame, “striped” of their free will. They were dispelled by the autonomy of judgment, and suffered a lobotomy of the objective analytical capacity of the event.

It should be recalled that, in the first instance, which took place from 15 to 24 November 2022, 49 persons are sentenced to death. At the appeal trial (15-23 October 2023), the Attorney-General at the Court of Algiers, dated 23 October 2023, announced the verdict in a communiqué: death penalty against thirty-eight defendants, convicted of “intentional homicide with premeditation, torture and incitement to torture, wilful fire of the crops that have resulted in the death of several persons, creation and membership of a group or organization engaged in acts of harassment. Just that. Why did these eleven people “deserved” death in the first instance verdict and not on appeal? Secondly, how can so many people be sentenced to death without providing any credible evidence?

At the historic Nuremberg trial (November 1945-October 1946), which ruled Nazi dignitaries involved in a global conflict that had resulted in the death of some 60 million people, the Military Tribunal sentenced to death “only” 12 out of 22 accused, all of whom were supporters of “the final solution”.

With regard to the murder itself, how could the hundred or so persons in questionloral work together in order to premeditate such an act? So do let suffer the kabyle opportunistic voices acquired with the regime!

According to APS (Algeria Presse Service, the Algerian state news agency), the Pravda of the junta or the Voice of its Master, the persons sentenced to death have been found guilty in particular of “terrorist and subversive acts that have undermined the security of the State, the national unity and the stability of institutions; plot”. “It is absolutely shameful that the Algerian authorities use the lynching of a man to prosecute their critics and members of the Movement for the Self-Determination of Kabylia (MAK). This stubborn repression is a serious violation of the rights to freedom of expression and association, but also of the right to life,” insisted the same Amna Guellali.

It should be noted that the trials of the accused are tainted by violations of fair trial guarantees and allegations of torture, while at least six of the accused were prosecuted for their alleged political affiliations, Amnesty International said on 9 January 2023 after the verdict of 2022. In 2023, five accused reported to the court that they had been subjected to torture or ill-treatment in detention.

After I “paulously laid down” the above lines, I am seized by a frantic urge to shout at the front of the criminal power of the Regency: where are the buoys assassins of Matub Lwennas (1956-1998), Tahar Djaout (1954-1993), Kamel Amzal (1962-1982) …, personalities of high intellectual qualities and human personalities? Between 2001 and 2003, the death toll was 128 (127 deaths on the spot and a 128th protester later died as a result of his injuries), hundreds of injuries, some of whom were disabled for life.

Although the killers of Kabyle protesters are clearly identified by citizens and village committees, no prosecution is under way. Iwet-iyi Waɛṛav, šetkaɣ-as i gma-s (Arab power kills, Arab power is investigating). They ransacked the school where the deceased taught before writing on her coat: ‘Long live the national gendarmerie and down with Tamazight”.

Although the accusations are overwhelming for the colonial forces, and singularly for the gendarmerie, there is and will never be a trial against these rascals, these murderers with an irrepressible desire to “break the Zwawi (Kabyle)”. Not even in a sham trial, in order to innocent the guilty sordides. Move, there’s nothing to see. And the groomed gerontor – the supreme leader of the assassins – died of his small death, without fear of the God to whom he erected an “uninhabitable palace,” who swallowed up some 150 billion Algerian dinars, probably in a final attempt to absolve his kabyle scathed and crimes, only out of a belief in Allah.

Since 1962, an arbitrary and murderous power has established itself on the ruins of another colonialism, which has driven and replaced Ottoman expansionism in 1830. And it relentlessly tracks down those who are “illegal” to denounce, courageously, state oppression over Kabylia.
